Welcome to GlowState Red Light Therapy Pty Ltd (ABN: 7269 2892 827) (“GlowState”, “we”, “us”, or “our”). These Terms & Conditions govern your access to and use of our website (www.glowstatetherapy.com.au) and the purchase of any products from us.

By accessing our website or purchasing our products, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or purchase our products.

1. About Us

GlowState Red Light Therapy Pty Ltd is an Australian registered company.  We sell red light therapy panels, caps, joint wraps, stands, and related accessories.

All our goods ship directly from Australia, and all purchases include free shipping within Australia.

2. Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms & Conditions limits, modifies, or excludes any rights or remedies you may have under the ACL.

3. General Wellness Disclaimer

All products sold by GlowState, including red light therapy panels, caps, joint wraps, and stands, are sold as general wellness and consumer products. They are not medical devices, and no therapeutic claims are made about them.

Disclaimer: GlowState red light therapy products are general wellness products. They are not intended to provide medical advice and should not be used as a substitute for professional healthcare guidance. If you have any health concerns, consult a qualified healthcare professional prior to use.

By purchasing our products, you acknowledge and agree that:

•        Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

•        Any information provided on our website, packaging, or marketing materials is for general informational and educational purposes only and does not constitute medical advice.

•        You should consult with a qualified healthcare professional before using our products, particularly if you have pre-existing medical conditions, are pregnant, or are taking medications that may cause photosensitivity.

•        GlowState makes no therapeutic claims regarding the efficacy of our products for any specific medical condition.

•        Our products are intended for use by adults and are not intended for use by children. You should read the safety information and contraindications set out in the product manual before first use.

4. Using Our Website

These Terms also apply to your access to and use of our website.

•        Acceptable use: You may use our website only for lawful purposes. You must not use it in any way that breaches any applicable law, is fraudulent or harmful, infringes the rights of others, or interferes with the operation or security of the website. You must not attempt to gain unauthorised access to the website, scrape or harvest data from it, or introduce any malicious code.

•        Accounts and information: If you create an account or place an order, you are responsible for keeping your account details secure and for activity that occurs under your account. You agree that the information you provide to us is accurate, current, and complete, and that you will keep it up to date.

•        Third-party links and tools: Our website may contain links to, or tools provided by, third parties that we do not control. We provide these for convenience only and on an “as is” basis, and we are not responsible for the content, products, or practices of any third-party website or tool. Your use of them is at your own risk and subject to the relevant third party’s terms.

While we take care to keep it accurate and current, we do not warrant that website content is complete, accurate, or up to date, and any reliance you place on it is at your own risk. This does not limit your rights under the Australian Consumer Law.

5. Our Products

We make every effort to display our products and their colours, finishes, and details accurately. However, the way a product appears on your screen may vary depending on your device and its settings, and minor variations of this kind are not a fault.

We reserve the right to change product descriptions and specifications, to discontinue any product, and to limit the quantity of any product we supply to any customer or region, at our discretion. This does not affect your rights under the Australian Consumer Law in relation to products you have already purchased.

6. Orders and Pricing

•        Eligibility: By placing an order, you confirm that you are at least 18 years of age (the age of majority in Australia) and able to enter into a binding contract.

•        Pricing: All prices on our website are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST), as GlowState is registered for GST.

•        Order acceptance: When you place an order, you are making an offer to purchase. We reserve the right to accept or reject any order at our discretion. An order is only accepted when we dispatch the goods and send you a shipping confirmation. Once an order is accepted, we may be unable to change or cancel it, so please review your order carefully before submitting it.

•        Pricing and product errors: The price that applies to your order is the price displayed at the time you place it, as shown in your order confirmation. Occasionally information on our website may contain an error — for example, in a price or product description. Where this occurs, we may correct the error and decline or cancel any affected order, even after it has been submitted. If we cancel an order you have already paid for, we will refund you in full.

•        Payment: Payment must be made in full at the time of placing the order. We accept major credit cards and other payment methods as displayed at checkout.

7. Shipping and Delivery

•        Free shipping: We offer free shipping on all orders delivered within Australia.

•        Dispatch: All goods are shipped from our facilities in Australia. We aim to dispatch orders promptly; however, delivery times may vary depending on the courier and your location.

•        Delivery times: Any delivery dates or timeframes we provide are estimates only and are not guaranteed. We are not responsible for delays caused by carriers or by other events outside our reasonable control. This does not affect your right under the Australian Consumer Law to have services supplied within a reasonable time.

•        Risk and title: Risk of loss or damage to the goods passes to you upon dispatch from our facilities. Title to the goods passes to you once we have received full payment. We recommend customers retain their tracking information. If goods are lost or damaged in transit, please contact us promptly so we can assist with a carrier claim.

8. Returns and Refunds

In addition to your statutory rights under the ACL, GlowState offers the following return and refund policy.

Change of Mind Returns

We accept change-of-mind returns within 30 days from the date of confirmed delivery (as evidenced by proof of delivery from the carrier). To be eligible for a return, the item must be:

•        In its original, undamaged packaging;

•        In clean, resaleable condition, with no physical damage, and with all accessories, documentation, and components included; and

•        Accompanied by proof of purchase.

To initiate a return, please submit a Returns Request through the returns form on our website before sending any goods back. We will review your request and, if approved, provide you with return instructions and a return authorisation reference.

Customers are responsible for arranging and paying for their own return shipping using a trackable, insured service. GlowState accepts no responsibility for items lost or damaged in transit during a return.

Once we receive the returned goods, we will inspect them to confirm they meet the above conditions. If the return is approved, a full refund of the original purchase price will be issued to your original payment method within 5–10 business days of inspection. If the returned goods do not meet our conditions (for example, they are physically damaged, have missing components, or are not in original packaging), we will notify you and may decline the return or offer a partial refund at our discretion.

Returns postmarked or dispatched after the change-of-mind window will not be accepted.

Faulty or Defective Items

If you believe an item is faulty or not of acceptable quality, please submit a Returns Request through the returns form on our website as soon as possible, including your proof of purchase, a description of the fault, and photographs where possible. We will assess your claim and, where the fault is confirmed, we will cover the reasonable cost of returning the item (or arrange and pay for its collection, where the item is large or heavy) and provide a repair, replacement, or refund in accordance with the ACL and our Warranty (see Section 9 below).

If, after assessment, the item is found not to have a fault, we will let you know and may ask you to pay the reasonable costs of collection and inspection. We will provide you with an estimate of any such costs before they are incurred.

9. Product Warranty

In addition to your rights under the Australian Consumer Law, GlowState red light therapy panels are covered by a two (2) year limited warranty. GlowState warrants your panel against defects in materials or workmanship for two (2) years from your purchase date.

GlowState red light therapy wraps, caps, masks and other products are covered by a one (1) year limited warranty.  GlowState warrants your wrap, cap, mask or other items against defects in materials or workmanship for one (1) year from your purchase date.

At its discretion, GlowState will either repair or replace your product if it is found, on inspection by GlowState or a service agent assigned by GlowState, to have any such defect within the relevant warranty period.

This warranty does not cover damage caused by:

•        Improper use;

•        Accidental damage;

•        Unauthorised modification; or

•        Exposure to liquids or high humidity environments.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits provided under this warranty are in addition to, and do not limit, your rights under the Australian Consumer Law.

How to make a warranty claim: To make a warranty claim, please submit a Returns Request through the returns form on our website, or contact us using the details below, with your proof of purchase and a description of the defect, including photographs where possible. You will not be charged for return shipping on an approved warranty claim; we will advise you of the return or collection method when your claim is accepted. If, after assessment, no qualifying defect is found, we may ask you to pay the reasonable costs of collection and inspection, for which we will provide an estimate in advance.

10. Intellectual Property, Trademarks, and Resale

All content on our website, including text, graphics, logos, images, and software, is the property of GlowState or our content suppliers and is protected by Australian and international copyright laws.

You may use our website and its content for your own personal, non-commercial use only. You must not reproduce, distribute, modify, or republish any content from our website without our prior written consent.

The “GlowState” name and logo are trademarks of GlowState Red Light Therapy Pty Ltd. Unauthorised use of our trademarks, or of any mark substantially similar to them, is strictly prohibited. All rights reserved.

Personal Use and Resale

All products purchased from GlowState are intended for your own personal use. You must not resell, redistribute, or otherwise commercially exploit any product purchased from our website without our prior written consent. We reserve the right to refuse or cancel orders that, in our reasonable judgement, appear to be placed for the purpose of resale or commercial distribution.

11. Reviews and Feedback

If you submit reviews, comments, photographs, or other feedback to us or through our website (“Feedback”), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, publish, and display that Feedback in connection with our business, including in our marketing. You confirm that you own or have the rights to the Feedback you submit, that it is accurate and not misleading, and that you have disclosed any incentive or payment you received for providing it. We are not obliged to publish, keep confidential, or pay for any Feedback, and we may decline to publish or may remove Feedback at our discretion.

12. Relationship with Shopify

Our website and store are powered by Shopify, which enables us to provide them to you. However, any sale or purchase you make is made directly with GlowState. You acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and us, including any injury, damage, or loss resulting from products or services purchased from us, and you release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with GlowState.

13. Limitation of Liability

To the maximum extent permitted by law (including the ACL), GlowState’s liability for any claim arising out of or in connection with these Terms & Conditions, our website, or our products is limited to:

•        The replacement of the goods or the supply of equivalent goods;

•        The repair of the goods;

•        The payment of the cost of replacing the goods or acquiring equivalent goods; or

•        The payment of the cost of having the goods repaired.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website. Nothing in this section operates to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.

14. Privacy

Your personal information is collected, used, and disclosed in accordance with our Privacy Policy, which is published on our website and forms part of these Terms. As our store is hosted by Shopify, our Privacy Policy also explains how Shopify collects and processes personal information in providing the website to you. To the extent of any inconsistency between these Terms and our Privacy Policy in relation to the collection, processing, or disclosure of personal information, our Privacy Policy applies. By using our website, you acknowledge that you have read and understood our Privacy Policy.

15. General

•        Severability: If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force.

•        Waiver: If we do not enforce a right or provision of these Terms, that is not a waiver of that right or provision.

•        Entire agreement: These Terms, together with our Privacy Policy and any other policies referred to in them, form the entire agreement between you and us regarding your use of our website and your purchases, and supersede any prior agreements on that subject.

•        Assignment: You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours, for example as part of a sale or restructure of our business.

•        Survival: Any provisions of these Terms that by their nature should continue after your use of our website ends — including those relating to intellectual property, limitation of liability, and governing law — will survive.

These Terms & Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising out of or relating to these Terms & Conditions will be subject to the exclusive jurisdiction of the courts of Queensland.

17. Amendments

We may update these Terms & Conditions from time to time, for example to reflect changes in our products, business practices, or legal requirements. The version of the Terms & Conditions that applies to your purchase is the version published on our website at the time you place your order. Any changes will be published on our website and will take effect for orders placed after the updated version is posted. We encourage you to review these Terms & Conditions before each purchase.
